10. LEGAL REQUIREMENTS AND COMPLIANCE

You are responsible for:

  • Complying with all local, state, and federal laws and regulations
  • Obtaining any required permits or permissions
  • Following all rules at the locations where you use equipment
  • Respecting private property and restricted areas
  • Maintaining adequate personal insurance coverage

11. BINDING AGREEMENT

  • This disclaimer and all rental terms constitute a binding legal agreement
  • You will sign a detailed rental agreement before receiving equipment
  • All terms are binding and enforceable to the fullest extent of the law
  • If any provision is found unenforceable, all other provisions remain in effect
  • California law governs this agreement
  • Any disputes must be resolved in the appropriate California courts

12. PARENTAL/GUARDIAN RESPONSIBILITY

If a minor is using rental equipment:

  • Parent/legal guardian must sign all agreements
  • Parent/guardian assumes ALL liability and risks on behalf of minor
  • Parent/guardian must provide continuous supervision
  • Parent/guardian is financially responsible for all damage and loss

13. ACKNOWLEDGMENT OF UNDERSTANDING

By proceeding with equipment rental, you acknowledge that you have:

  • Read and fully understand this disclaimer
  • Had opportunity to ask questions and seek legal counsel
  • Voluntarily chosen to rent equipment despite the risks
  • Been advised to obtain personal insurance coverage
  • Understand you are giving up substantial legal rights

14. NO RELIANCE ON RELEASED PARTIES

Do not rely on SF Wingfoil Academy, Captain Joshua Waldman, or any staff for:

  • Assessment of whether you should rent equipment
  • Evaluation of your skill level or readiness
  • Determination of safe conditions
  • Advice about where or when to use equipment

YOU MAKE ALL DECISIONS AND ACCEPT ALL CONSEQUENCES.

15. EMERGENCY CONTACT AND MEDICAL INFORMATION

You must provide:

  • Emergency contact information
  • Relevant medical conditions or medications
  • Acknowledgment that you may be far from medical facilities
  • Understanding that emergency response may be delayed

16. PHOTOGRAPHIC RELEASE

You consent to SF Wingfoil Academy photographing or filming you using rental equipment for promotional purposes unless you specifically opt out in writing.

17. ENTIRE AGREEMENT

This disclaimer, together with the signed rental agreement, constitutes the entire agreement between you and SF Wingfoil Academy regarding equipment rental. No oral statements or representations modify these terms.


BY RENTING EQUIPMENT FROM SF WINGFOIL ACADEMY, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND VOLUNTARILY AGREE TO ALL TERMS IN THIS DISCLAIMER AND WILL SIGN A COMPLETE RENTAL AGREEMENT BEFORE RECEIVING ANY EQUIPMENT.

IF YOU DO NOT AGREE TO THESE TERMS, DO NOT RENT EQUIPMENT.

WING FOILING IS DANGEROUS. PEOPLE HAVE BEEN SERIOUSLY INJURED AND KILLED. RENTAL EQUIPMENT DOES NOT MAKE THE ACTIVITY SAFE. YOU ASSUME ALL RISKS.
